Terms of Service

These Terms of Service ("Terms") govern your use of FishMemory, a service operated by Monaï Telecom ("we," "our," or "us"). By using FishMemory, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

FishMemory is a reminder management service that includes:

  • A WhatsApp bot that processes natural language messages to create, manage, and deliver reminders
  • A mobile application (iOS and Android) with calendar views and reminder management
  • A web application for reminder management
  • Google Calendar integration for two-way sync
  • Push notification delivery

2. Account & Authentication

  • Your WhatsApp phone number serves as your unique account identifier.
  • Authentication is performed via OTP (one-time password) sent to your WhatsApp.
  • You are responsible for maintaining the security of your phone number and device.
  • You must be at least 13 years old to use the Service.
  • One account per phone number. Sharing accounts is not permitted.

3. Free Trial

  • New users receive a 30-day free trial with unlimited reminders and all features.
  • The free trial includes natural language processing in all supported languages, all recurring pattern types, Google Calendar sync, push notifications, and task tagging.
  • When the trial period ends, you can subscribe to continue using the Service.

4. Subscription & Payment

  • FishMemory offers two plans: $3 USD per month or $12 USD per 6 months.
  • Payment is processed through Whish Money. To subscribe, contact us via WhatsApp.
  • Your subscription is activated upon confirmed receipt of payment.
  • Subscriptions are non-refundable once activated, except where required by law.
  • Subscriptions do not auto-renew. You will be notified before expiration and can choose to renew.
  • If you do not renew within 30 days of expiration, your data may be permanently deleted.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal, fraudulent, or harmful purpose
  • Send spam, bulk messages, or automated requests to the WhatsApp bot
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the Service's infrastructure
  • Use the Service to store, transmit, or process sensitive personal data of third parties without their consent
  • Create multiple accounts to abuse the free trial
  • Resell or redistribute access to the Service

6. Intellectual Property

  • FishMemory, its name, logo, mascot, and all associated branding are trademarks of Monaï Telecom.
  • The Service's source code, algorithms, NLP engine, and design are the exclusive property of Monaï Telecom.
  • You retain ownership of the content of your reminders. By using the Service, you grant us a limited license to process and store your reminder content solely for the purpose of providing the Service.

7. Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
  • The Service depends on third-party platforms (WhatsApp, Google, Expo) that are outside our control.
  • We reserve the right to perform maintenance with reasonable advance notice.
  • We are not liable for missed reminders due to service outages, network issues, or force majeure events.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • We are not liable for any damages arising from missed reminders, data loss, or service interruptions.
  • Our total liability to you shall not exceed the amount you paid for the Service in the 6 months preceding the claim.
  • We are not responsible for any actions you take or fail to take based on reminders delivered or not delivered by the Service.

9. Termination

  • You may stop using the Service at any time by simply ceasing to interact with the WhatsApp bot and mobile app.
  • You may request complete account deletion by contacting us at support@monaitelecom.com.
  • We may suspend or terminate your account if you violate these Terms, with notice where practicable.
  • Upon termination, your data will be retained for 30 days and then permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms. For significant changes, we will notify you via WhatsApp.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Lebanon. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Beirut, Lebanon.
